Protecting Your Rights: The Practical Implications of Litigation in the Construction Industry

Arizona law provides various mechanisms for contractors to protect their rights with respect to projects for which they provide materials and/or services (e.g., mechanics’ and materialman’s liens). But what happens if those mechanisms do not result in payment and litigation becomes necessary?  We will discuss the different types of litigation you may encounter when seeking to enforce your rights and what you can expect from those processes.

About the Speaker
Justin V. Niedzialek is an attorney with the Phoenix office of Dunn DeSantis Walt & Kendrick, LLP. His areas of practice include labor and employment law, creditors’ rights, judgment enforcement, commercial litigation, and bankruptcy law. He serves a diverse client base including individuals, small and large businesses, and financial institutions. Prior to joining DDWK, Justin spent time in solo practice, and before starting his own practice, he was a member at The Cavanagh Law Firm. He has conducted numerous trainings and CLEs in various areas of law including judgment enforcement, the Fair Debt Collections Practices Act, and labor and employment best practices. Justin is an Arizona native, received a Bachelor of Arts degree, cum laude, in psychology from the University of San Diego, and received his Juris Doctor from the University of Arizona, James E. Rogers College of Law. In addition to other activities, Justin is a Committee Member of the Phoenix Torero Club (the local chapter of the University of San Diego Alumni Association) and has previously been a member on the board of directors of multiple nonprofit organizations.
